Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the websites, student portals, online services, communications, and digital content operated by Advanced Pharmacy Academy, LLC (“APA,” “we,” “us,” or “our”), including advancedpharmacyacademy.com (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. About APA

APA provides online pharmacy technician education, career information, student support, and related educational resources. References on the Services to program recognition, certification, examinations, registration, licensure, employment, or career pathways are provided for educational purposes and are subject to the requirements of the applicable organization, employer, or government authority.

APA is a PTCB-Recognized Education/Training Program. PTCB recognition does not mean that PTCB endorses APA, guarantees that any student will be eligible to take or pass an examination, or guarantees certification, registration, licensure, externship placement, or employment.

2. Relationship to Other Agreements and Policies

These Terms govern general use of the Services. If you enroll in an APA program, your enrollment is also governed by the student enrollment agreement, refund and cancellation policy, program catalog or syllabus, academic policies, and any other terms presented at enrollment. If these Terms conflict with a signed enrollment agreement regarding tuition, payment, cancellation, refunds, academic requirements, program completion, or included benefits, the enrollment agreement controls.

Our Privacy Policy explains how we collect, use, and disclose personal information. Any separate consent you provide for email, telephone, or text-message communications also applies.

3. Eligibility and Accounts

You must be legally capable of entering into a binding agreement to use the Services. A minor may use the Services only with the involvement and consent of a parent or legal guardian and subject to any enrollment eligibility requirements.

When creating an account or submitting information, you agree to provide accurate, current, and complete information. You are responsible for keeping your login credentials confidential and for activity occurring through your account. You may not share an individual student account or allow another person to complete coursework, assessments, attendance requirements, or other program activities on your behalf. Notify APA promptly at support@advancedpharmacyacademy.com if you believe your account has been accessed without authorization.

4. Educational and Career Information

APA makes reasonable efforts to provide useful and accurate information, but certification, registration, licensing, and employment requirements may change and may differ by state, employer, and individual circumstance. You are responsible for confirming the current requirements that apply where you live or intend to work.

Enrollment or completion does not guarantee examination eligibility, a passing score, certification, state registration or licensure, an externship, employment, promotion, compensation, or any other professional outcome. Estimates regarding completion time depend on factors including pace, participation, mastery, and satisfaction of program requirements.

Nothing provided through the Services is legal, medical, financial, or employment advice. Educational demonstrations and pharmacy-related content are not a substitute for professional judgment, workplace policies, applicable law, or supervision by a licensed pharmacist or other qualified professional.

5. Enrollment, Payments, Refunds, and Third-Party Financing

Program descriptions, tuition, payment options, included materials, access periods, and benefits are those displayed or agreed to at the time of enrollment and may be changed prospectively. Enrollment is not complete until required agreements and payment arrangements have been accepted.

Refunds and cancellations are governed by the refund and cancellation policy and the student enrollment agreement applicable to your enrollment, including any rights that cannot legally be waived. Payment plans or financing offered by third parties, including buy-now-pay-later providers, are also governed by the third party’s terms. APA does not control a third party’s approval decision, fees, payment schedule, collection activity, or privacy practices.

6. License to Use the Services

Subject to these Terms and any applicable enrollment agreement, APA grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services and course materials for your own lawful, noncommercial educational use.

The Services and their content—including text, videos, lectures, graphics, assessments, workbooks, textbooks, downloads, branding, software, and course design—are owned by APA or its licensors and are protected by intellectual-property laws. Except where APA gives written permission, you may not copy, reproduce, publish, distribute, sell, sublicense, publicly display, record, scrape, upload, create derivative works from, or commercially exploit any portion of the Services. You may not remove copyright, trademark, or ownership notices.

Purchasing or downloading content does not transfer ownership of the content or its intellectual-property rights.

7. Acceptable Use and Academic Integrity

You may not use the Services to violate any law; interfere with security or operation; introduce malicious code; gain unauthorized access; impersonate another person; collect information about other users without permission; harass others; submit unlawful, misleading, defamatory, or infringing material; or use automated means to extract content or data without written permission.

Students must complete required coursework and assessments honestly. Cheating, sharing answers, unauthorized collaboration, falsifying identity or participation, or having another person complete work may result in academic action, suspension, or termination, subject to the applicable student policies and law.

8. Communications and Support Tools

APA may communicate with you through email, telephone, text message, the student portal, or support tools regarding inquiries, enrollment, coursework, account activity, services you request, and other matters permitted by your choices and applicable law. Message and data rates may apply. Where required, marketing messages will be sent only with appropriate consent, and you may withdraw that consent using the instructions in the message. Consent to receive marketing messages is not a condition of purchase.

APA may use automated tools, including artificial-intelligence-assisted support, to help answer questions or route requests. Automated responses may be incomplete or inaccurate. For decisions involving enrollment status, payments, academic standing, certification eligibility, or other significant matters, contact APA staff for confirmation.

9. User Submissions

If you submit feedback, questions, comments, reviews, photographs, or other content to APA, you retain any ownership rights you have. You grant APA a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and use the submission as reasonably necessary to operate, improve, and respond through the Services.

APA will not use your name, image, testimonial, or student story in public advertising merely because you contacted us or submitted support content. Any public promotional use requiring permission will be based on a separate authorization or other lawful basis.

You represent that you have the right to submit your content and that it does not violate another person’s rights or applicable law.

10. Third-Party Services and Links

The Services may link to or integrate with third-party platforms, payment processors, financing providers, learning tools, examination organizations, social networks, or external websites. APA does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. A link or integration does not necessarily imply endorsement. Your use of a third-party service is governed by that provider’s terms.

11. Availability and Changes

We may maintain, update, improve, suspend, or discontinue parts of the Services. We do not guarantee that the Services will always be uninterrupted, secure, or error-free. For enrolled students, any material change affecting purchased access or program obligations will be handled under the enrollment agreement and applicable law.

We may update these Terms prospectively. The revised Terms will be posted with a new effective date. When legally required, we will provide additional notice or obtain consent. Changes do not retroactively alter rights or obligations that arose before the revised Terms became effective.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” APA DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. APA DOES NOT WARRANT THAT THE SERVICES WILL MEET EVERY USER’S NEEDS OR THAT ALL CONTENT WILL BE COMPLETE, CURRENT, OR ERROR-FREE.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you. Nothing in these Terms limits any non-waivable consumer right.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APA AND ITS OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, APA’S TOTAL LIABILITY FOR A CLAIM RELATING TO GENERAL WEBSITE USE WILL NOT EXCEED $100. FOR A CLAIM ARISING FROM AN ENROLLED STUDENT’S PURCHASE OR PROGRAM PARTICIPATION, ANY MONETARY LIMITATION WILL BE DETERMINED BY THE APPLICABLE ENROLLMENT AGREEMENT AND LAW.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless APA and its owners, officers, employees, instructors, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or content you submit. This section does not require a consumer to indemnify APA for APA’s own unlawful conduct, negligence, or willful misconduct.

15. Suspension and Termination

APA may restrict or terminate access when reasonably necessary to protect the Services or other users; address fraud, security concerns, nonpayment, academic misconduct, or violations of these Terms; or comply with law. When the user is an enrolled student, any academic or enrollment consequence will also be governed by the applicable student agreements and policies.

Provisions that by their nature should survive termination—including intellectual-property, disclaimers, liability limitations, indemnification, and dispute provisions—will survive.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where the law of your state provides rights that cannot be waived. Any court proceeding relating to these Terms or general use of the Services must be brought in a state or federal court with jurisdiction in Los Angeles County, California, unless applicable law gives you the right to bring it elsewhere.

Before filing a claim, you and APA agree to make a good-faith effort to resolve the matter informally by sending written notice describing the concern and requested resolution. Notices to APA should be sent to support@advancedpharmacyacademy.com. This informal process does not prevent either party from seeking urgent relief or using a government or small-claims process, and it does not extend or shorten any legal deadline.

17. Copyright Concerns

If you believe material available through the Services infringes your copyright, send a notice to support@advancedpharmacyacademy.com identifying the copyrighted work, the allegedly infringing material and its location, your contact information, a statement of your good-faith belief that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your physical or electronic signature.

APA may request additional information needed to process the notice. If APA elects to rely on the safe-harbor procedures of the Digital Millennium Copyright Act, it may separately designate and register an agent with the U.S. Copyright Office.

18. General Terms

These Terms and the policies incorporated into them form the entire agreement concerning general use of the Services. They do not replace an enrollment agreement or another separately executed contract. If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. APA’s failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without APA’s written consent. APA may assign these Terms in connection with a merger, reorganization, sale of assets, or similar transaction, subject to applicable law.
